WABASHA, Minn. (KTTC) – Requests continue to be filed in the ongoing federal lawsuit between Wabasha-Kellogg School District and a former student. The former student alleges they endured bullying while attending school and the district fostered an environment of bullying and sexual harassment. The district has denied these allegations in court.
The suit was filed in December of 2024. In recent court filings, the district’s defense alleges the student engaged in the conduct that the student is now alleging was harmful, such as the use of derogatory terms and making fun of other students. The district even filed examples of the district’s discipline toward the student. The student’s attorney, however, allege those disciplinary documents are fabricated.
Both sides now have a slew of motions to dismiss allegations. That will be up to the federal judge. According to court filings, both parties agree the case will be ready for trial in January of 2027.
A hearing happened Wednesday but was not open to the public.
The lawsuit asks for damages, stating the student will continue to suffer from emotional distress and mental anguish from the bullying they allegedly endured.
